He was imprisoned and fined for "playing music at a level that caused distress" to his neighbors.
A pensioner who has been imprisoned for playing music too loud has died while he was in jail. According to reports, 83-year-old Ian Trainer has been locked up for 24 weeks in February 6 for violating a restraining order. After he was released, he ended back in prison again, following complaints that he still breached the order.
Apparently, the old man from Aintree, Merseyside has been asked by the court not to play music above normal talking level – which is 65 decibels – between the hours of 9AM and 10 PM. However, he just loved playing his Classic FM radio a bit too loud and so he was jailed once more after he was released.
When he was sentenced in February, Trainer told an officer at the Liverpool Magistrate Court that he loved listening to music “at a level I enjoy,” also explaining that a medical condition prevented him from using headphones instead. A court statement said Trainer could only hear in one ear, reported Newsweek.
Meanwhile, Thomas Michael Thompson, one of his neighbors, complained of “noise pollution” because of Trainer’s habit
He said:.
“It’s not just one day of the week, it’s every day of the week. I go out early morning and stay out until late afternoon to avoid the noise. It’s just unbelievable at times.”
The judge sentenced Trainer to a 24-week imprisonment for “playing music at a level that caused distress.” He was also asked to pay pay £600 court costs and £122 victim surcharge for Thompson. In June, he appeared in court via video link, pleading not guilty and just dismissing accusations saying they wre “malicious lies.”
A spokesperson from the Ministry of Justice recently confirmed:
“HMP Liverpool prisoner Ian Trainer died in hospital on 23 November. The Prisons and Probation Ombudsman has been informed.”
His cause of death was not mentioned by the authorities.
